Agriculture and food

Challenges and requirements

The agricultural sector is currently witness to an exciting development. The liberalisation of the Danish Act on Agriculture in 2010 presents interested parties with a number of new opportunities to own and run an agricultural business. Moreover, a consolidation of the sector as well as an optimisation of its accomplishments is contemplated. The sector is highly regulated, both nationally and on the EU plane. In order to stay up to date with the rules governing, for example, food safety, fodder, food additives, genetically modified foods and functional foods, as well as labelling and marketing, a continual focus is necessitated. Businesses often seek legal advice on the scope of the many and complex EU regulations, available subsidy schemes and on the execution of contracts.

How we can help

During the course of a number of years, we have advised many different types of businesses on a broad spectrum of agricultural and food related issues. Moreover, we have rendered advice throughout the entire value chain, i.e. from food raw materials to food manufacturing to marketing. This experience has given us a thorough insight into and understanding of the sector, which we actively integrate into our advice. We assist both larger and smaller businesses within the agriculture and food sector, for example, cooperative societies, advice centres and production companies, as well as wholesale and retail companies.

 Our advice encompasses, among others:
  • Regulatory matters
  • Protection of intellectual property rights
  • Labelling and marketing, including "green" marketing
  • Risk management and compliance programmes
  • Interpretation of EU regulations and contact with the EU Commission
  • Product recall and product liability
  • Transport liability
  • Contact with public authorities, e.g. concerning the conduct of food inspections
  • Drafting of contracts, including development and supplier contracts
  • Sales and delivery conditions
