Bech-Bruun wins personal injury compensation case before the Danish Supreme Court
Bech-Bruun has represented insurers in a case concerning a financial settlement after a car accident in 2000.
The injured person, at the time of the car accident, worked as a carpenter. During the court case, he claimed that his earnings would have been substantially higher than those estimated by the insurance company when making a payout for loss of earnings and loss of earning capacity.
The Supreme Court held that there was no basis for increasing the claimant’s annual salary or the assessed amount relating to his loss of earning capacity.
The judgment confirms that in order to calculate a loss based on future expectations, quite concrete evidence is required.
