Insurance

Challenges and requirements
The insurance industry is witness to heightened competition both domestically and abroad and increased public regulation. Industry actors are more focused on the utilisation of resources, product development and compliance. Our clients, therefore, require a better utilisation of resources and added legal value.

How we can help
We are focused on development and optimisation within the insurance industry. During the course of many years, we have built up key competencies with respect to, for example, the development of life insurance and injury insurance products, the distribution of insurance products, the handling of injury cases and the insurance business in general. In addition, we have significant experience in advising on cross-border insurance business, branch related M & A transactions and the handling of substantial compensation claims on behalf of, for example, international insurers. We monitor the insurance industry closely, which ensures that we are always up to date with the challenges which the industry faces.

One of our key competencies is our substantial experience in conducting litigation proceedings and arbitration cases. Our lawyers conduct a significant number of cases before the ordinary courts and arbitration tribunals, for example, the Danish High Court and the Danish Supreme Court.

Our client portfolio consists of insurance companies specialising in pension and injury insurance, insurance brokers and mediators, captives, businesses, organisations and public authorities.

Our advice encompasses, among others:
• Corporate insurance and regulatory matters
• Insurance mediation
• Life and pension insurance
• Commercial and product liability insurance
• Professional liability insurance, e.g. for lawyers, accountants, architects and engineers
• Directors and officers liability insurance
• Personal and industrial injury insurance
• Property, project and building insurance
• Environmental/pollution insurance

Jes Anker Mikkelsen and Henrik Valdorf-Hansen jointly lead Bech-Bruun’s practice, for which recent work includes regulatory matters, insurance portfolio transfers, and high-value domestic and international disputes. Mikkelsen, who shows ‘good judgement and deep understanding of Danish insurance law’, is Danish counsel to Lloyd’s of London, and Valdorf-Hansen is advising If in a case concerning damage to the foundations of 2,000 wind turbines in Germany and Austria. Together with Anne Buhl Bjelke, Valdorf-Hansen is representing Noreco in a dispute regarding insurance cover for damages to an offshore installation. Mogens Gaarden and Jacob Jørgensen strengthened the team when they joined as part of the Philip Law Firm merger.
