We have extensive experience with bankruptcy and insolvency issues and administer estates in bankruptcy of all sizes and within all industries.

We ensure that the estate's assets are realised in the best possible manner. Either through an entire sale of the financially well-functioning part of the business or at the highest attainable prices.

Moreover, we ensure that any transactions made at an undervalue, preferences given to suppliers, customers or financial institutions as well as any unlawful charges to property which occurred in the period prior to the bankruptcy, are challenged before the courts and reverted to the estate for distribution to all creditors.

We always work from the point of view that the winding-up proceedings should cause the creditors as little inconvenience as possible.

Common challenges
When a business gets into financial difficulty, it creates uncertainty. Not only for the business and its owners, but also for suppliers, employees and other creditors.

If the reconstruction of the business is not feasible, it is important that the winding up of the business takes place as soon and as quickly as possible and with the involved parties experiencing the least loss possible.

On the restructuring and insolvency side the team again had a busy year. Ole Borch, for example, led a team in acting as the administrator in an in-court restructuring process for Da’core, utilising a new model of in-court restructuring. Borch was again in the lead as the team assisted MSE, with Tryg and Nordea as the major creditors, on its multi-million euro bankruptcy which managed to continue construction projects the company was working as it was being restructured and sold to new owners.
