Hvordan kan vi hjælpe?
Vi rådgiver kommuner, regioner og selvejende institutioner inden for alle de juridiske områder, der har betydning for dem. Vi har dyb indsigt i de særlige vilkår, som offentlige myndigheder og organisationer opererer inden for.

Ekspropriation er en af vores kompetencer, ligesom vi har mange års erfaring med at rådgive om planlovgivning, vejforhold, ledningsejeres retsstilling, sikkerhedsproblemstillinger, infrastrukturforvaltningsaftaler og gener forbundet med anlæg og drift af infrastruktur.

Vores brancheteam med speciale i den offentlige sektor har stor indsigt i aktuelle kommunalretlige forhold. Vi kender det landskab, som offentlige myndigheder med et politisk bagland navigerer i – også i forbindelse med samarbejdsaftaler og kontrakter, hvor en myndighed agerer privatretligt. 

Vores store kendskab til offentlige forhold betyder desuden, at vi kan hjælpe vores klienter med at udvise rettidig omhu.

Sektorens udfordringer
Den offentlige sektor gennemgår i disse år en omfattende omstillingsproces. Når store offentlige opgaver skal udføres, indtager sektoren ofte en konkurrence- og udbudsbaseret tilgang, som også involverer den private sektor, i stedet for den hidtidige monopolbaserede struktur.

Forsyningssektoren undergår også store ændringer, og en række offentlige opgaver bringes nu i udbud.

Når offentlige opgaver udføres i kommunale fællesskaber og offentlig-private partnerskaber (OPP) og samarbejder (OPS), er behovet for rådgivning stort – især inden for retsområder, som ikke traditionelt har haft offentlige myndigheders fokus.

Work highlights Assisted several regions of Denmark with the preparation and implementation of new hospital projects, including advice in connection with the preparation, planning and implementation of the projects.

Represented the Danish Road Directorate in a Supreme Court case relating to the interpretation of the Danish Road Act and the concepts of property and locus standi under Danish law, in matters relating to landowner rights to buy land that was formerly under public ownership.

Notable practitioners
Hakun Djurhuus is particularly known among interviewees as a "really good environmental lawyer" while sources also praise his abilities in public law trials. He is also active in administrative law and often assists with construction matters. He successfully represented Metroselskabet in a Supreme Court case regarding liability for costs incurred in rerouting pipelines around the Cityringen metro construction site.

The five-partner team is led by the ‘very skilled and service-mindedHåkun Djurhuus and Jacob Brandt, who stands out for his ‘strategic mindset and experience from the regulatory side’. The group advised the Municipality of Fredericia in relation to the spillage of liquid fertiliser in the harbour. Other highlights include the department assisting Femern with public law matters regarding the construction of a tunnel; and advising Nord Stream 2 on the construction and operation of two pipelines in the Baltic Sea, including the environmental impact assessment.
